Recently, a NY District Judge ruled that the government should be required to get a warrant in order to retrieve location data from your cell phone provider. I’m sure you are aware that your physical location can be found out by following the signal from your cell phone to the closest cell phone tower. However, many are unaware that this information can be obtained by government officials without a warrant. Easy access to this data is a significant violation of privacy. I think this NY Judge got it right! Modern technology shouldn’t stomp all over the 4th amendment. The government should be required to show probable cause that the location data is needed and relevant for a specific investigation.
